1. Introduction
Welcome to Thomas Datt and The Producers Portal.
These Terms of Service govern your use of the Thomas Datt website and your purchase, booking and participation in services, mentorship programmes and sessions offered by Thomas Datt and The Producers Portal.
By accessing this website, purchasing a service, enrolling in a mentorship programme or booking a session, you agree to be bound by these Terms of Service.
If you do not agree with these Terms, you should not use this website or purchase or participate in our services.
2. The Producers Portal Services
The Producers Portal provides music production mentorship, track production guidance, creative development and related mentorship services.
Services may include:

The specific inclusions, number of sessions, programme duration and applicable timeframe for each service are described on the relevant product or sales page at the time of purchase.
3. Nature of the Mentorship Services
The Producers Portal provides personalised mentorship, guidance, feedback and educational support relating to music production and creative development.
Mentorship may be adapted to the individual producer, their music, creative process, production challenges, strengths and development.
No specific musical, commercial, financial, career, release, record label, streaming, chart or music industry outcome is guaranteed.
Results will vary between participants and may depend on the participant's existing skills, experience, participation, implementation of feedback and individual creative development.
4. Discovery Session
The Discovery Session is a private 2 hour 1-2-1 music production mentorship session with Thomas Datt.
The session is focused on the participant's music, track production, creative decisions and individual production challenges.
The Discovery Session must be booked and attended within any booking or validity period stated on the relevant product page or communicated at the time of purchase.
24hrs notice of rescheduling is expected.
Naturally you will receive a recording of your session.
5. Group Mentorship
Group Mentorship is a live small-group music production mentorship programme limited to the number of participants stated on the relevant programme page.
Group Mentorship sessions take place on the dates and times advertised for the relevant programme intake.
Participants are responsible for ensuring they are available to attend the scheduled sessions.
Due to the live and progressive nature of Group Mentorship, missed group sessions will not ordinarily be rescheduled individually.
Unless otherwise agreed by The Producers Portal or required by applicable law, a participant who does not attend a scheduled group session will not be entitled to an individual replacement session.
Any session recordings provided are made available at the discretion of The Producers Portal and are for the participant's personal use only.
As this is a Group Mentorship session times cannot be change.
Naturally you will receive a recording of each session.
6. Accelerator Mentorship — 2 Month Programme
The Accelerator Mentorship is a 2 month private 1-2-1 music production mentorship programme.
The programme includes:

4 private 2 hour 1-2-1 mentorship sessions with Thomas Datt; and
-
1 bonus 1 hour individual growth and Human Design session with Alicia Singleton.
The Accelerator Mentorship begins on the date of the participant's first mentorship session with Thomas Datt and runs for two consecutive months.
All included mentorship and bonus sessions must be booked and completed within the 2 month mentorship period.
Participants are responsible for booking and attending their sessions within the programme timeframe.
Except where required by applicable law or where otherwise agreed by The Producers Portal in writing due to exceptional circumstances, unused sessions cannot be carried forward beyond the 2 month mentorship period.
The programme is intentionally structured as a progressive mentorship experience, with each session building on the work, implementation and development arising from previous sessions.
24 hrs notice of rescheduling is expected.
Naturally you will receive recordings of your sessions.
7. Professional Mentorship — 4 Month Programme
The Professional Mentorship is a four-month private 1-2-1 music production mentorship programme.
The programme includes:

8 private 2 hour 1-2-1 mentorship sessions with Thomas Datt; and
-
2 private 1 hour individual growth and Human Design sessions with Alicia Singleton.
The Professional Mentorship begins on the date of the participant's first mentorship session with Thomas Datt and runs for four consecutive months.
All eight mentorship sessions with Thomas Datt and both individual growth sessions with Alicia Singleton must be booked and completed within the 4 month mentorship period.
Participants are responsible for scheduling and attending all included sessions within the programme timeframe.
Except where required by applicable law or where otherwise agreed by The Producers Portal in writing due to exceptional circumstances, unused sessions cannot be carried forward beyond the 4 month mentorship period.
The four-month timeframe is an integral part of the programme structure. Sessions are intended to provide progressive development, implementation and review rather than operate as disconnected individual appointments.
24 hrs notice of rescheduling is expected.
Naturally you will receive recordings of your sessions.
8. Elite Mentorship — 6 Month Programme
The Elite Mentorship is a six-month private 1-2-1 music production mentorship programme.
The programme includes:

12 private 2 hour 1-2-1 mentorship sessions with Thomas Datt; and
-
3 private 1 hour individual growth and Human Design sessions with Alicia Singleton.
The Elite Mentorship begins on the date of the participant's first mentorship session with Thomas Datt and runs for six consecutive months.
All twelve mentorship sessions with Thomas Datt and all three individual growth sessions with Alicia Singleton must be booked and completed within the 6 month mentorship period.
Participants are responsible for scheduling and attending all included sessions within the programme timeframe.
Except where required by applicable law or where otherwise agreed by The Producers Portal in writing due to exceptional circumstances, unused sessions cannot be carried forward beyond the 6 month mentorship period.
The six-month programme is designed as a progressive mentorship experience. The continuity and timing of sessions form an important part of the mentorship methodology.
24 hrs notice of rescheduling is expected.
Naturally you will receive recordings of your sessions.
9. Programme Timeframes and Participant Responsibility
The applicable mentorship programme timeframe is clearly stated before purchase and forms part of the service being purchased.
Participants are responsible for:

Booking sessions with sufficient notice;
-
Maintaining reasonable availability throughout the programme;
-
Attending confirmed sessions;
-
Completing sessions within the applicable programme timeframe; and
-
Allowing sufficient time to book remaining sessions before the programme end date.
Purchasing a mentorship programme does not extend, pause or suspend the stated programme timeframe.
Participants should not wait until the final weeks of their programme to attempt to book all remaining sessions.
The Producers Portal is not responsible for a participant's failure to book or attend sessions within the applicable programme period where reasonable booking opportunities have been made available.
Where Thomas Datt, Alicia Singleton or The Producers Portal is unable to provide a confirmed session due to circumstances within our control, reasonable arrangements will be made to reschedule the affected session.
Where appropriate, the programme timeframe may be adjusted to accommodate a delay caused by The Producers Portal or the relevant mentor.
Nothing in this section excludes or restricts rights available under the Australian Consumer Law.
10. Booking, Rescheduling and Missed Sessions
Participants must book mentorship sessions through the booking method provided by The Producers Portal.
If a participant needs to reschedule a private session, they must provide at least 24 hours' notice before the scheduled session time.
Where at least 24 hours' notice is provided, the session may be rescheduled subject to availability and the applicable programme timeframe.
Where a participant fails to attend a confirmed session or cancels or requests to reschedule with less than 24 hours' notice, the session may be treated as used, except where required by applicable law or where The Producers Portal agrees otherwise due to exceptional circumstances.
Repeated rescheduling may affect the participant's ability to complete all included sessions within the applicable mentorship period.
Rescheduling a session does not automatically extend the applicable 2 month, 4 month or 6 month mentorship programme timeframe.
All sessions must still be booked and completed within the relevant programme period unless an extension is agreed in writing by The Producers Portal or otherwise required by applicable law.
11. Sessions with Alicia Singleton
Certain Producers Portal mentorship programmes include bonus or supplementary individual growth sessions with Alicia Singleton.
These sessions may use Human Design as a framework for personal exploration, individual growth and creative development.
Human Design sessions are provided for personal development and reflective purposes only.
They do not constitute medical, psychological, psychiatric, therapeutic, legal or financial advice and are not a substitute for services provided by an appropriately qualified professional.
Where Alicia Singleton's sessions are included within a fixed-term mentorship programme, those sessions must also be booked and completed within the applicable programme timeframe.
12. Participant Music and Creative Materials
Participants may provide music, audio files, project materials, written information and other creative content for the purpose of receiving mentorship and feedback.
Participants retain ownership of their original music and creative works.
By providing materials to Thomas Datt, Alicia Singleton or The Producers Portal, the participant grants permission for those materials to be accessed, listened to, reviewed and discussed solely for the purpose of providing the purchased mentorship or related service.
The Producers Portal does not acquire ownership of a participant's music or original creative works by receiving those materials for mentorship purposes.
13. Confidentiality and Group Participation
The Producers Portal will take reasonable steps to respect the confidential nature of music and creative materials shared during private mentorship sessions.
Participants in Group Mentorship must respect the privacy, music, ideas and creative materials shared by other participants.
Participants must not record, reproduce, distribute, upload, share or commercially exploit another participant's music, feedback, session contributions or creative materials without that person's express permission.
Unauthorised sharing of another participant's materials or confidential programme content may result in removal from the programme.
14. Intellectual Property, Music and Licensed Content
Unless otherwise stated, Thomas Datt and/or the relevant licensors retain ownership of all intellectual property rights in the website, music, recordings, compositions, audio files, production materials, mentorship materials, programme frameworks, written materials, videos, graphics and other content made available through the Thomas Datt website or The Producers Portal.
Thomas Datt Music and Recordings
Music, compositions, sound recordings and other creative works released, published or made available by Thomas Datt remain protected by applicable copyright and intellectual property laws.
Unless music or content is expressly identified as royalty-free or supplied under a specific licence, no licence for commercial use, reproduction, redistribution, adaptation, synchronisation, sampling or incorporation into another creative work is granted.
The purchase, streaming, download or access of Thomas Datt's music does not transfer copyright or ownership of the music, composition or sound recording to the purchaser or listener.
Unless expressly authorised by Thomas Datt or the relevant rights holder, users must not reproduce, distribute, sell, sublicense, sample, adapt, commercially exploit or use Thomas Datt's music or recordings in another production.
Royalty-Free and Licensed Content
Certain music, audio, samples, sounds, production materials or other digital content may be expressly offered for sale under a royalty-free or other specified licence.
Purchase of royalty-free or licensed content does not transfer ownership or copyright in the original content to the purchaser.
Instead, the purchaser receives a limited, non-exclusive and non-transferable licence to use the purchased content in accordance with the licence terms stated on the relevant product page or supplied with the digital content.
Where content is expressly identified as royalty-free, the purchaser may use the licensed content within their own original music, audio, video, media or creative productions, including commercial productions, subject to the applicable licence terms.
Unless expressly permitted by the applicable licence, purchasers must not:

Resell, redistribute, sublicense or share the original content or files;
-
Make the original content or files available for download by another person;
-
Upload or distribute the content as a standalone music, sample, sound, audio or production product;
-
Claim ownership or authorship of the original licensed content;
-
Register the original licensed content, or a substantially unaltered version of it, as their exclusive work;
-
Register the original licensed content with a content identification system in a manner that may restrict lawful use by Thomas Datt or other authorised licensees;
-
Use the content to create or sell a competing royalty-free music, sample, sound or production library; or
-
Transfer the licence to another person or business without prior written permission.
A royalty-free licence means that, following lawful purchase, the purchaser may use the licensed content in accordance with the applicable licence without paying ongoing royalties to Thomas Datt for each permitted use.
Royalty-free does not mean copyright-free, public domain or unrestricted use.
Any additional licence conditions displayed on the relevant product page or supplied with the purchased content form part of the licence granted to the purchaser.
Mentorship Materials
Mentorship materials, programme frameworks, written materials, videos, recordings and other content supplied through The Producers Portal remain the intellectual property of Thomas Datt and/or the relevant rights holder.
Participants are granted a limited, personal, non-exclusive and non-transferable right to use mentorship materials for their own learning and development.
Unless prior written permission is provided, participants must not reproduce, distribute, sell, sublicense, publicly share or commercially exploit mentorship materials.
Participants must not share private session recordings, republish paid programme materials, use mentorship materials to create a competing course, programme or mentorship service, or record private or group mentorship sessions without permission.
Participant Music and Creative Works
Nothing in this section transfers ownership of music or original creative works submitted by a participant for mentorship purposes.
Participants retain ownership of their original music and creative works, subject to any third-party rights that may apply.
Materials submitted for mentorship may only be accessed, listened to, reviewed and discussed for the purpose of providing the purchased mentorship or related service.
15. Artwork, Visual Content and Brand Intellectual Property
Unless otherwise stated, Thomas Datt and/or the relevant rights holders retain all applicable intellectual property rights in artwork, visual content and brand materials displayed, published or made available through the Thomas Datt website, The Producers Portal and associated services.
This may include, without limitation, album and single artwork, release artwork, The Producers Portal artwork and visual concepts, portal and programme artwork, symbols, glyphs, icons, graphic elements, logos, branding, visual identity, photographs, promotional imagery, website graphics, videos, animations, motion graphics and other visual or artistic content.
Artwork and visual content are protected by applicable copyright and intellectual property laws.
Unless expressly licensed or authorised in writing, users must not copy, reproduce, modify, adapt, distribute, publish, sell, sublicense, commercially exploit or use artwork or visual content to create derivative commercial materials.
Users must not remove, obscure or alter copyright notices, branding, watermarks or other rights-management information attached to or displayed with artwork or visual content.
The purchase of music, digital content, a mentorship session or a Producers Portal mentorship programme does not transfer ownership of, or grant a licence to use, Thomas Datt or The Producers Portal artwork, branding, visual identity or other visual intellectual property unless those rights are expressly granted in writing or included within the applicable product licence.
Where artwork or visual content is owned or licensed by a third party, use of that content remains subject to the rights of the relevant rights holder.
16. Fees and Payment
The price of each service or mentorship programme is displayed at the time of purchase.
Prices are displayed in the currency identified in USD on the relevant product or checkout page.
Payment must be made using the payment methods available at checkout.
Where a payment plan is offered, the participant remains responsible for agreed instalments in accordance with the payment arrangement, subject to rights and remedies available under applicable law.
Failure to make an agreed payment may result in the suspension of future mentorship sessions until the outstanding payment is resolved.
17. Cancellations and Refunds
Participants should choose their mentorship programme carefully.
Change-of-mind refunds are not automatically provided after purchase.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
Where a service does not meet an applicable consumer guarantee, the participant may be entitled to a remedy in accordance with Australian Consumer Law.
If The Producers Portal is unable to supply a purchased service, reasonable steps will be taken to provide an appropriate alternative, reschedule the affected service or provide another remedy as required by applicable law.
Requests relating to exceptional personal circumstances may be considered individually. Consideration of such a request does not guarantee a refund, programme extension or transfer.
Australian consumer guarantees apply automatically to services, and remedies can include cancellation or a refund depending on the nature of the failure.
18. Website Use and Restrictions
Users must not:

Use this website unlawfully;

Attempt to interfere with the operation or security of the website;

Copy or commercially exploit website content without permission;
-
Use website content in a manner that infringes intellectual property rights;

Misrepresent their relationship with Thomas Datt or The Producers Portal; or
-
Use the website or services in a manner intended to harm another person or business.
19. Website Disclaimer
The website and its content are provided for general information and to describe services offered by Thomas Datt and The Producers Portal.
Reasonable efforts are made to maintain accurate information. However, website content, programme availability and future service offerings may be updated from time to time.
Nothing in these Terms excludes any guarantee, warranty, right or remedy that cannot lawfully be excluded.
20. Limitation of Liability
To the maximum extent permitted by law, Thomas Datt and The Producers Portal will not be liable for indirect or consequential loss arising from a participant's use of the website or participation in mentorship services where such liability may lawfully be limited.
Nothing in these Terms excludes, restricts or modifies liability, consumer guarantees or other rights where doing so would be unlawful.
21. Indemnification
To the extent permitted by law, participants agree to indemnify Thomas Datt and The Producers Portal against reasonable losses, liabilities, costs and expenses arising directly from:

Unlawful use of the website;

Infringement of another person's intellectual property rights;
-
Unauthorised sharing or commercial use of programme materials; or
-
A material breach of these Terms.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down or removed to the extent necessary without affecting the remaining provisions.
23. Changes to These Terms
These Terms may be updated from time to time.
The Terms applicable to a mentorship programme will generally be those presented or made available at the time of purchase, except where a change is required by law or expressly agreed with the participant.
24. Assignment and Transfer of Programmes
Thomas Datt and The Producers Portal may assign or subcontract rights or obligations where reasonably necessary for the operation or delivery of the services.
Participants may not sell, transfer or assign a mentorship programme or unused mentorship sessions to another person without prior written approval from The Producers Portal.
25. Entire Agreement
These Terms, together with the relevant product description, programme inclusions, checkout terms and any written agreement specifically relating to the participant's purchase, constitute the agreement relating to the purchased services.
26. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia and applicable Commonwealth laws of Australia.
The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
